2020年10月17日,第十三届全国人民代表大会常务委员会第二十二次会议颁布了《未成年人保护法(2020修正案)》。该立法修正案具有相当程度的进步意义,但其仍然未能实质性地弥补《未成年人保护法》素有的缺陷,也未能对其关键机制进行系统的完善,更未能实现立法理念提升的目标。因此,针对现存的问题,应当放弃边缘修补的保守思路,将少年法律规范予以系统整合,构建具有独立部门法地位的"少年法",时机成熟时可以制定"少年法典",这会为未成年人法治事业的建设提供系统的方案和最优的方略。

  • On October 17, 2020, the 22 nd meeting of the Standing Committee of the 13 th National People's Congress promulgated the Juveniles Protection Law(2020 Amendment). The 2020 amendment to the Law has its progressive significance, but still fails to fix its defects in essence. Its response to the current situation is mostly superficial, fails to achieve the systematic improvement of its key mechanism, and stays far from improving the legislative ideal. Giving up the conservative way of marginal amending, to construct the juveniles law systematically, departmentally, even to codify the juveniles law, it will provide a systematic plan and optimal strategy for the construction of juveniles rule of law.
