摘要：

有效的制度激励是推动无人驾驶产业快速发展的重要动力。当前,我国无人驾驶产业的制度激励在激励对象、激励性质、激励措施以及激励重点方面存在局限,难以为无人驾驶产业发展提供切实有效的支持和保障。立足于无人驾驶产业发展的现实场景与目标要求,无人驾驶产业的制度激励理念应凸显动态调整的实质,在发展促进与风险防控之间寻求动态平衡。同时,选择激励市场与激励政府相结合的双重激励模式,构建宏观与微观协同、鼓励与约束并举的制度激励框架。其中,制度激励的重点应该放在明确无人驾驶侵权责任制度、健全产业投融资制度和完善知识产权保护制度三个方面。

  • Effective institutional incentives are an important driving force to promote the rapid development of the driverless industry.At present,the institutional incentives of the driverless industry in China have limitations in terms of the incentive recipient,incentive nature,incentive measures and incentive focus,which makes it difficult to provide effective support and guarantee for the development of the driverless industry.Based on the realistic scene and objective requirements of the development of the driverless industry,the institutional incentive concept of the driverless industry should emphasize the essence of dynamic adjustment and seek a proper balance between development and risk prevention and control.At the same time,we should choose the dual incentive mode of combining incentive market and incentive government,and build an institutional incentive framework where the macro and micro aspects are coordinated,and encouragement and restraint are equally important.Emphasis should be put on institutional incentives in three areas:clarifying the tort liability system for driverless driving,creating a sound industrial investment and financing system and improving the intellectual property protection system.
