基层政府分层治理模式考察——基于农业产业培育行动逻辑的分析

摘要：

实施乡村振兴战略,既是实现全体人民共同富裕的必然选择,也是维护和保障农民发展权的必然要求。在推进乡村振兴战略中,基层政府围绕如何培育农业产业,形成"差序治理模式"的行动逻辑,即基层政府依据村庄间实际条件的差异确定优先扶持的秩序,并据此提供种类和数量不同的扶持政策。从提升农业产业扶持资源的使用效率来讲,差序治理模式具有一定合理性。但是,这种模式也易造成产业扶持和培育资源的非均衡分配,导致不同权利目标间的失衡和农民发展权的不平等对待。基于法治视角的分层治理模式,应当遵循公平与效率相兼顾的原则,采取法治化的分类治理策略,扩大农民参与权,促进农民发展权的平等保护。

  • Realizing the strategy of rural revitalization is the inevitable choice of achieving the common prosperity of the people,and the inevitable requirement of maintaining and protecting the farmers' right of development. When implementing the strategy of rural revitalization,the basic-level government form the logic of action of differential governance concerning how to cultivate agricultural industry,that is,the basic-level government offers different supportive policy based on the actual condition of the villages. In terms of increasing the service efficiency of the supportive resources of agricultural industry cultivation,the model of differential governance is reasonable to a certain degree. However,this model also tends to cause disequilibrium assignment of resources,and consequently leads to the unbalance of rights and unequal treatment of the farmer 's right of development. From the approach of the rule of law,the model of differential governance shall abide by the principle of balancing fairness and efficiency,adopt legalized classified governance strategy,improve the farmers' right to participate,and strength the protection of the farmers' equal right of development.
