摘要：

宪法宣誓是国家治理、社会秩序整合和公众行为约束的一项十分重要的法律制度。这一法律制度的实施,不仅能有效聚合社会群体,弥合社会分化以及激活公众的共同情感、深化公众的共同认知、引领公众同向行为。同时,宪法宣誓制度对公职人员具有强制性约束功效,即合法程序强制约束、权力运行强制约束、信守社会公德强制约束等功效。更重要的是宪法宣誓制度的责任追究功效,即对公职人员从宪法宣誓场域内的承诺和宪法宣誓场域外的履职行为进行全过程全方位的监督与控制,凡不践行宣誓承诺的行为就会依法受到责任追究和惩罚。

  • Pledging Allegiance to Constitution is a very important legal system for national governance,integration of social order and restriction of public behaviors. This legal system plays an important role in unifying social groups, bridging social differentiation, activating the shared feelings of the public,deepening their shared cognition, and leading their behaviors towards the same goal. Furthermore, the system of pledging allegiance to the Constitution is mandatorily binding on public officials. Specifically,it has the effects such as mandatory constraint by procedures, mandatory constraint by statutory duties,mandatory constraint by social morality. More important, the system of pledging allegiance to the Constitution has an effect of "accountability". Public officials are supervised from all aspects in the entire process through the commitment made in the premise where they pledge allegiance to the Constitution and their duty performance outside the premise. Any behaviors violating the pledge will be held accountable and punished.
