摘要：

我国非法证据排除路径在某种程度上呈现出规则限缩适用的趋势。通过非法证据排除规则来遏制非法取证行为与实现权利救济是当前该规则建构和运行的基本模式,但依据规则演化的形态特征及共性与个性问题,表明其适用现状并不乐观。目前非法证据排除规则存在着抉择上的双重冲突、样态上的二元割裂、救济上的双重忧虑等逻辑困境,这也决定了其逻辑起点应以非法取证行为排除及警察个体责任落实为本位,规则改革的方向应当从证据排除转向行为排除。此外,非法取证行为排除威慑及引导效果的充分发挥,有赖于便宜化的技术机制、全面化的监督机制及层级化的惩戒机制共同支撑。

To some extent, the exclusion path of illegal evidence in China presents the trend of limitation of rules. Containment of illegal evidence collection and right relief through the rule of illegal evidence exclusion is the basic mode of construction and operation of the rule. The logic dilemma, such as double conflict in choice, dual split in pattern and double worry in relief, also determines that the logical starting point of illegal evidence exclusion rules in china should be based on the exclusion of illegal evidence collection and the implementation of individual police responsibility. By deconstructing the exclusion of illegal evidence, the direction of rule reform should be from evidence exclusion to behavior exclusion. The elimination of deterrence and the full play of the guiding effect of illegal forensics depends on the cheap technical mechanism, comprehensive supervision mechanism and hierarchical disciplinary mechanism.
