摘要：

《民法典》对虚拟财产规定的变迁史表明立法者并未就虚拟财产的法律属性形成单一化的确定结论。事实上,虚拟财产的法律性质不宜笼统判断,作非此即彼的单一结论,而应视具体虚拟财产的不同特点、构造作个别确定。虚拟财产具有多元属性。虚拟财产的具体法律属性与其可继承性之间没有必然关联。在《民法典》下,虚拟财产是"自然人合法的私有财产",可被纳入遗产范围进行继承。虚拟财产的多元属性说明其对法律保护的需求是多元化的,未来应在《民法典》的指引下继续推动虚拟财产的专门立法。

  • The history of regulations of virtual property in the Civil Code of China shows that legislators have not formed a simplified definite conclusion on the legal attributes of virtual property. The legal attributes of virtual property should not be judged in general terms and concluded in an either-this-or-that way. Instead, it should be determined respectively according to the different characteristics and structures of virtual properties. Virtual property has multiple attributes. There is no necessary connection between the specific legal attributes of virtual property and its inheritability. Under the provisions of the Civil Code, virtual property is "the legal private property of a natural person" and can be included in the scope of inheritance. The diverse nature of virtual property shows that its demand for legal protection is diversified. In the future, we should continue to promote the special legislation of virtual property under the guidance of the Civil Code.
