摘要：

检察机关是我国的法律监督机关。长期以来,检察机关的工作重点主要放在刑事领域,而相对较少涉足民事诉讼这块"私权纠纷"的化解场所。在我国社会快速转型时期,在程序自治和审判独立日显重要的今天,人们发现检察机关不能对民事诉讼袖手旁观,而应当加大监督的力度,拓展监督的广度,并有权提起公益诉讼。这样便产生了诸多的理性悖论与问题争议。本期视点,邀请数位学者专家围绕公益诉讼中检察监督问题展开讨论,试图找出解决问题的理论路径。

  • Procuratorate is the institution responsible for legal supervision in China,and in a long time,it mainly focuses on the criminal areas and rarely steps into civil action--the private dispute resolution forum.However,in the era of China's social transforming and at the background of the procedure autonomy and adjudication independence being more and more valued nowadays,it is realized that the procuratorate can no longer pay no attention to the civil action,in contrast,the procuratorate shall intensify its efforts and broaden its coverage of supervision on civil action,and shall be authorized to file the public interest cases.Naturally,a number of issues will arise accordingly.In the "legal focus" of this volume,we hope various scholars and experts will expose theirs points and contribute the theories to resolving the is- sues.
