中国内陆自由贸易港的制度选择与立法构建

摘要:

在建设更高水平开放型新体制的背景下,对外开放高地建设是符合我国对外开放制度建设历史经验的新成果,仍需要不断地完善和发展。尤其是内陆地区,对外开放高地建设仍存在开放型经济发展不协调、产业转型程度较低和区域辐射带动效应不强等问题。无论从现实需求层面分析,还是国家战略层面分析,内陆自由贸易港的建设都有其必要性。同时,许多内陆地区凭借突出的区位优势、良好的基础服务设施、便利的交通条件和广阔的国内外市场,具有建设自由贸易港的可行性。就内陆自由贸易港的立法模式而言,我国应在法治框架内由中央授权、地方立法,并赋予内陆自由贸易港更大的创新自主权,采用自上而下的立法方式,让法制统一与地方自主立法双向互动、互为促进。

  • In the context of building a new system of higher-level openness,the system of building highlands for opening up is a new achievement which is in line with China's historical experience in its institutional development for opening up and still requires continuous improvement.Especially in the inland areas,there are still some problems facing the construction of such a system including the uncoordinated development of an open economy,low degree of industrial transformation and weak regional radiation and leading effects.However,both at the level of realistic needs and at the level of national strategy,there is a need for the construction of inland free trade ports.At the same time,many inland regions have the feasibility of building free trade ports by virtue of their outstanding regional advantages,some achievements in innovating the opening-up system,good basic service facilities,convenient transportation and vast domestic and foreign markets.With regard to the initial concept and strategic choice of the inland free trade port system,China should promote the construction of inland free trade ports within the framework of the rule of law:in terms of the legislative model,the central government can delegate some legislative power to the local authorities,giving inland free trade ports greater autonomy in innovation and adopting a top-down legislative approach that is conducive to a good interaction and mutual promotion between the unification of the legal system and the local autonomous legislation.
