摘要：

自贸区便利的地理条件和贸易政策使其成为国际货物运输的中转地。对自贸区临时过境货物的知识产权行政执法涉及出口国、过境国、目的国以及相关各方的利益,我国理论界就是否应对自贸区临时过境货物进行知识产权行政执法有两种不同的观点。相关国际公约并未对过境货物知识产权执法进行强制性规定,欧盟将有足够的证据表明过境货物将会进入欧盟市场流通作为其采取边境措施的前提条件。我国自贸区应在维护国家利益的前提下,坚持过境货物的知识产权保护和促进贸易自由兼顾以及行政有限介入原则,根据过境货物在出口国、过境国、目的国的不同知识产权权利状态进行灵活处理。

  • Due to the Convenient geographic traffic environment and the preferential policy Free Trade Area is inclined to be the freight station of the Goods-in-transit. The IPR enforcement of the Goods-in-transit in Free Trade Area is related to interests of all parties involved in the exporter,importer and intransit country. There are two different points in China. The full evidence that Goods-in-transit will enter the EU market is the prerequisite of the IPR enforcement in EU. The related international covenants don't make a clear regulation about the IPR enforcement of the Goods-in-transit. On the prerequisite of Safeguarding national interests we should consider the trade free and the protection of IPR and enforce neatly according to the different situations.
