摘要：

将社会主义核心价值观融入裁判文书说理,是法院践行和弘扬社会主义核心价值观,实现司法政治功能的重要途径,也是司法裁判引领公序良俗价值的应有之义。社会主义核心价值观作为善意文明之柔性价值,可以弥补司法刚性规则面对纷繁复杂现实的天然不足;司法反复适用社会主义核心价值观说理论证的过程,也是社会主义核心价值观内涵与外延不断发展与丰富的过程。目前司法实践在运用核心价值观说理论证时,失之于粗、浅、宽,无论准度、精度、深度都存在诸多问题,亟须明确核心价值观说理的一般原则,准确把握核心价值观说理的准度、空间以及限度,才能最大限度发挥司法对社会主义核心价值观的培育和弘扬、社会主义核心价值观对我国特色社会主义法治建设的思想引领作用。

  • It is an important way for the court to carry out and advance and enrich the socialist core values and realize the judicial political function by integrating the socialist core values into the reasoning of judicial documents.It is also the proper meaning of judicial judgment to lead the value of public order and good customs.As the flexible value of good faith civilization,socialist core values can make up for the natural deficiency of judicial rigid rules in the face of complex reality.The process of the judicial application of the theory of socialist core values is also the process of the continuous development and enrichment of the connotation and extension of the socialist core values.However,when the theory of core values,which is too rough,simple and broad,is applied in judicial practice,there are many problems in accuracy,precision and depth.Accordingly,it is urgent to clarify the general principles of core values reasoning,and accurately grasp the accuracy,space and limit of core values reasoning,so as to give full play to the ideological leading role of justice in the cultivation and promotion of socialist core values and the ideological guidance of socialist core values in the construction of socialist rule of law with Chinese characteristics.
