"律令体制"说肇始于日本汉学界。中华法系不应归结为"律令体制",而是一种"礼法体制"。从"礼法体制"来重新认识中华法系,以廓清长期以来对其的误读、误解和误判,揭示古代中国法由礼典、律典、礼俗习惯法组成的法律样式,寻求中华法系追求"礼法之治""良法善治"的法文化遗传密码。

The theory of Ritsuryo System originated from Japanese Sinology. Chinese legal system is an Etiquette System that should not be narrowed to Ritsuryo System. Therefore, to clear up the perennial misunderstanding of Chinese legal system, this paper re-examines Chinese legal system from the perspective of Etiquette System. It reveals that the mode of Chinese laws are composed of rites, codes and customary laws and discovers the genetic codes of Chinese legal culture, i.e., the pursuits of Rule of Etiquette, and Good Law and Governance.
