摘要：

水下地形地物性质的认定与判断是《联合国海洋法公约》实践中的难点之一,主权国家的相关实践都从有利于本国的角度对水下地形地物进行性质的认定,在这一过程中就会产生主权国家间的权利重叠区域。为了解决这一海洋争端,国际司法实践积累了大量有关水下地形地物性质的判例,通过这些判例的研究可以得到如下结论:"水下地形地物"对于领土主权的宣示与确认没有意义,但"水下地形地物"对海洋区域划界有一定价值。

  • The identification and judgment of the underwater features is one of the difficult issues in the practice of UNCLOS. The practices of sovereign states all identify the legal status of underwater features from the perspective of their own interests. In order to settle maritime disputes, international judicial practice has accumulated a lot of cases about the legal status of the underwater features, from which we come to the following conclusions: the underwater features is of no significance to the declaration and confirmation of territorial sovereignty, but are valuable on the maritime delimitation.
