《关于解决国家与他国国民间投资争端公约》第47条规定了"建议性"临时措施,该表述触发了临时措施是否具有约束力的争议。实践中国际投资争端解决中心(ICSID)仲裁庭通过命令说和职能说两种观点赋予临时措施约束力,但命令说有违文义解释的基本原则;职能说又立足于似是而非的类比论证。临时措施所保护的权利才是其具有约束力的正当理据。权利与义务的对应揭示了临时措施虽然是仲裁庭之"建议",但基于当事人承担的义务因素而获得约束力。ICSID仲裁临时措施约束力的困境堪为镜鉴,中国应更新现有投资协议中有关投资仲裁临时措施规定过于"谨慎"的模式,并在为"一带一路"倡议供给投资仲裁临时措施规则时增加担保措施和公共政策损害补偿措施的内容,以在保护投资者权利与避免东道国权益受损之间实现中道平衡。此种新的"义利观"是塑造支撑"一带一路"倡议的区域性投资仲裁机制的向心力量。

  • Article 47 of Arbitration Rules in ICSID Convention provides "recommendations" for interim measures. It leads to the dispute on whether the interim measures have binding force. In practice, interim measures are binding in the ICSID arbitration court according to the empowerment theory and the competency theory. However, the empowerment theory is against the basic principle of literal interpretation and the competency theory is based on a vague analogy. It is the right protected by interim measures that gives legitimate grounds for the binding force of interim measures. The correspondence between rights and obligations reveals that although interim measures are "recommendations" of the arbitration tribunal, they are bound by the obligations assumed by the parties. China should take the ICSID's dilemma of the binding force of interim measures in arbitration into consideration and update the "over-prudent" model of interim measures for investment arbitration in the existing investment agreements. We should also add measures of guarantee and damages for the public policy into the interim measures of investment arbitration in the Belt and Road Initiative. These updates can strike the balance between protecting investors' rights and avoiding damages of host country's rights and interests. This new vision can also be the pillar to shape and support the regional investment arbitration mechanism of the Belt and Road Initiative.
