后脱贫时代社会参与扶贫的法律激励机制

摘要:

传统的行政扶贫模式在后脱贫时代面临诸多局限,引入社会主体参与扶贫,实现"单中心贫困治理"向"多中心贫困治理"转型具有客观必然性。然而,市场化的社会主体与行政化的精准扶贫、收益性的社会主体与公益性的精准扶贫、碎片化的社会主体与系统化的精准扶贫之间始终存在着较大的张力,而法律激励机制的引入为张力的打破提供了契机与路径。当前我国社会参与扶贫法律激励的制度安排存在理念层面的"管理型激励"、标准层面的"资格型激励"和方式层面的"帮扶式激励"等问题,故应当针对当前社会参与扶贫法律激励的问题,彻底实现"三个转变":即实现激励理念从"管理型激励"向"契约型激励"转变,实现激励标准从"资格型激励"向"绩效型激励"转变,实现激励方式从"帮扶式激励"向"合作式激励"转变,最终实现社会参与扶贫法律激励的效能最优。

  • The traditional administrative poverty alleviation model faces many limitations in the post poverty-alleviation era. It is objectively inevitable to introduce social entities to participate in poverty alleviation and realize the transition from "single-centre poverty governance" to "multi-center poverty governance".However,there is always a deep tension between the market-oriented social entities and the administrative targeted poverty alleviation,the profitable social entities and the public welfare targeted poverty alleviation,the fragmented social entities and the systematic targeted poverty alleviation,and the introduction of legal incentive mechanism provides an opportunity and path to break the tension.However,there are some problems in the current legal incentive system of social participation in poverty alleviation in China,such as "managerial incentive" at the conceptual level,"qualified incentive" at the standard level and "helping incentive" at the mode level. Therefore,we should completely realize the "three transformations" in response to the current problems of social participation in poverty alleviation legal incentives: the transformation of incentive concept from "managerial incentive" to "contractual incentive",the transformation of incentive standard from "qualified incentive" to "performance incentive",the transformation of incentive mode from "helping incentive" to "cooperative incentive",and ultimately achieve the best effectiveness of social participation in poverty alleviation legal incentives.
