迅猛发展的人工智能在给人类社会带来正外部性时,其产生的负外部性也随之而来,主要表现在冲击现有的社会经济秩序、弱化法律的调整功能、增加社会管理主体的治理成本等。这些负外部性的解决,当然离不开多个法律部门的共同努力,这些部门也存在必要的分工。从经济法视域来看,当前应该重点完善人工智能市场准入制度、市场监管制度、信息披露制度和主体责任制度,从而确保作为国家发展战略的人工智能健康良性发展。

  • When the rapid development of AI brings positive externalities to human society, its negative externalities also follow, which can be seen mainly in its impact of changing the existing social and economic order, weakening the adjustment function of the law, and increasing the costs of social management, etc. The resolution of these negative externalities must be worked out by multiple legal departments. From the perspective of economic law, we should focus on improving the AI market access system, market supervision system, information disclosure system and subject responsibility system. This could ensure that the healthy and sound development of AI be implemented as a national development strategy.
