对"自动续期"的解读应具备一定的解释论基础:生产资料与生活资料的不同特点、市场自由竞争与政府增进公益、法治人文关怀的不同功用、土地使用权上对住宅与非住宅的不同法律构造。基于上述基础,永久续期论无法成立,有偿续期论也需进行修正。"自动续期"的未来设计可以走一条介于无偿与有偿、永久与期限的中间道路:期限上,一次性将住宅建设用地使用权的期限延长至权利人的终生,而不是永久;对价上,为有条件无偿续期,但在完成保障基本居住条件的使命后转变为有偿申请续期,即权利期满后权利人转移权利或死亡的,受让人或继承人需要提出申请并缴纳相应费用方可取得法定期限的住宅建设用地使用权;非70年住宅建设用地使用权亦适用物权法"自动续期"的规定,并无偿续期至权利人的终生,但在进入申请续期阶段应由申请人补缴费用,以体现公平。

  • The interpretation of "automatic renewal" should have a certain hermeneutics basis: the different characteristics of production and living materials, the free competition of the market and the government's promotion of public welfare,the different functions of humanistic and rule of law care, and the different legal structures of land use right between the residence and the non-residence. Based on the above basis, the theory of permanent renewal cannot be established, and the theory of paid renewal also needs to be revised. The future design of "automatic renewal" can take a intermediate route between unpaid and paid, permanent and a fixed time: on the term, one-time extension of the term of the residential construction land use right is for a lifetime of the right holder, not permanent; on the consideration, renewal is conditional and free of charge, but after completing the mission of guaranteeing basic living conditions, it is converted into renewal of application for compensation, that is, if the right holder transfers rights or dies after the right expires, the assignee or heir needs to file an application and pay the corresponding fee can only obtain the right to use residential construction land for a statutory period; the right to use non-70-years residential construction land also applies to the "automatic renewal" provisions of the Property Rights Law,and is renewed for free for a lifetime of the right holder, however, the applicant shall make up the fees when entering the application renewal stage to reflect fairness.
