对柏拉图法律思想的重新解读

摘要:

传统的观点认为柏拉图在《理想国》中构建了一个乌托邦国家,他强调哲学王统治,轻视法律,反映了他反民主的人治思想;后期他培养哲学王失败,才转而在《法律篇》中表达了对法治的诉求。本文从柏拉图生活的时代背景去理解他的思想,得出了和传统观点不一致的看法。伯罗奔尼撒战争使希腊社会混乱、道德沦丧,怎样把握真理,消除智者意见的不良影响,是柏拉图关注的焦点。因为,只有符合真理的政治法律制度才是正义的,才能使社会秩序稳定。因此,我们理解,柏拉图一生一直是在为民主法治构建理论基础,晚年他感到自己没有精力在理论上继续开拓时,才将理论转化为制度,以期后人沿此方向继续探讨。

  • Traditionally,people think Plato constructed a Utopia in his book The Republic,which gives much emphasis on ruling by the king of philosophy and makes light of the law. The book,therefore,reflects his anti-democratic thought of rule by man. Only later in Plato’s life,when he failed to cultivate a king of philosophy,did he turn to the rule of law in his another book Laws. This article analyzes Plato’s legal thoughts against the background of the times in which he lived: the Peloponnesian War had led Greece into disorder and immorality. Plato focused on the issues of how to master the truth and how to eliminate the bad influence of the Sophists because he realized that only the political and legal systems that were in conformity with the truth could be the righteous ones and ensure social stability. The author believes that Plato had been laying a theoretical foundation for democracy and the rule of law throughout his life. Only late in his life,when he felt he had no longer enough energy to continue his theoretical research,did he try to turn his theory into institutions.
