摘要：

当代青年男女婚姻中签订"忠诚协议"的现象较为多发,我国立法对此没有明确规定,但司法实践中有关"忠诚协议"的诉讼时有发生。文章考察了近十年间司法机关对"忠诚协议"效力的认定情况,在对比有效、无效、自然债务三种学说的基础上,指出自然债务说是审理"忠诚协议"问题的正确裁判路径。具体而言,社会层面,应引导青年树立正确婚恋观;立法层面,扩大离婚损害赔偿制度的适用范围;司法层面,进一步阐释"其他重大过错"之内涵。

  • There are many "loyalty agreements" signed by young men and women in their marriages,the legislation of our country has no definite stipulation on this,but the judicial practice of this aspect occurs from time to time.This paper investigates the judicial authorities’ determination of the validity of "loyalty agreement" in the past ten years,on the basis of comparing the three theories of validity,invalidity and natural debt,this paper points out that natural debt is the right way to judge the "loyalty agreement".Specifically,at the social level,young people should be guided to establish a correct view of marriage;at the legislative level,the scope of application of divorce damages should be expanded;at the judicial level,the connotation of "other major faults" should be further explained.
