摘要：

当前,针对不满鉴定意见而引发的鉴定纠纷,当事人常采取多种维权方式,除鉴定投诉、信访上访外,有些会直接向法院起诉社会鉴定机构。通过研究发现,当事人起诉社会鉴定机构案件的裁判结果多为驳回起诉或诉讼请求,解决鉴定纠纷的效果不佳,且由于存在审理裁判困境,法院在处理此类案件时似乎觉得相当棘手。为了解决鉴定管理与诉讼规制未紧密衔接而衍生出的鉴定纠纷,以及倒逼鉴定机构/鉴定人重视提升鉴定质量,有必要合理构建当事人起诉鉴定机构制度。

  • At present,in response to the appraisal disputes caused by dissatisfaction with expertise conclusions,the parties often adopt various ways of safeguarding rights.In addition to complaints and letter visits,they also directly prosecute judicial expertise institutions.Through empirical research,it is found that most of judgment results that the parties prosecute judicial expertise institution are rejecting the prosecution or lawsuit requests.And the effectiveness of resolving the appraisal disputes is not good.Because of judgment dilemma,judge seems to feel quite difficult when dealing with such cases.However,in order to solve appraisal disputes arising from the lack of close connection between expertise administration and litigation regulations,and to force judicial expertise institution/expertise witness to pay attention to improving appraisal quality,it is necessary to reasonably build a system for the parties to prosecute judicial expertise institutions.The specific solutions include:first,to clearly stipulate the types that the parties can prosecute judicial expertise institutions;second,to construct the procedural of the parties prosecuting judicial expertise institutions.On the one hand,the expert committee of judicial appraisal set up by the Association of Forensic Science examines these expertise conclusions which haven't been accepted;on the other hand,the procuratorial organ carries out technical evidence examination of those accepted expertise conclusions.
