摘要：

国家监察委员会行使"监察法规"制定权是进一步完善和深化监察体制改革的关键一环。国家监察委员会不享有制定职权性监察法规的权力,国家监察委员会制定"监察法规"必须有宪法和法律依据,且获得《立法法》或全国人大及其常委会授权。国家监察委员会制定"监察法规"不能创设公民权利义务的行为规范,不能制定涉及法律绝对保留事项的内容;"监察法规"制定应当遵循正当法律程序原则。国家监察委员会制定"监察法规"既不能逾越立法边界,也不能超越司法界限。

  • Exercise of the power to formulate supervisory regulations is a key link for the National Supervisory Commission to further improve and deepen the reform of supervisory system. When it formulates"supervisory regulations",it cannot create norms of conduct concerning citizens' rights and obligations,nor can it formulate contents concerning matters that are absolutely reserved by law. It also should follow the principle of due process of law, neither going beyond the legislative boundary nor beyond the judicial boundary.
