摘要：

民众财产继承观念与习惯是立法之重要参考依据。为给我国民法典编纂提供第一手国情资料,对吉林、重庆等十省市民众的继承习惯进行实证调研,分析法定继承制度和遗嘱继承制度之民间习惯。从民法典编纂民意基础出发,提出我国继承法编一方面应维持配偶和尽了主要赡养义务的丧偶儿媳、女婿之继承地位;另一方面应增设配偶对遗产房屋的先取权与终生使用权并正面回应夫妻共同遗嘱效力问题。

  • People's concept and habit of property inheritance is an important reference for legislation. In order to provide first-hand information of the national conditions for the compilation of legal code, We conducted an empirical study on the inheritance habits of people in ten provinces and cities, and analyze the folk customs of statutory succession system and testamentary succession system. Based on the public opinion of codification, this paper puts forward that on the one hand, China's inheritance law should maintain the inheritance status of spouses and widowed daughters-in-law and sons-in-law who have done their main duty of support; on the other hand, we should add the spouse's preemptive right and lifetime use right to the estate house and positively respond to the effect of the husband and wife's joint will.
