犯罪中止行为是法律和社会赞许、支持的行为,与中止犯(犯罪行为)有着质的区别。立法者应当在价值取向上把中止犯的存在范围限定在严重犯罪之中和犯罪过程中的实行阶段、实行后阶段。中止犯的成立条件不能混同于犯罪中止的成立条件。我国刑法关于中止犯的规定存在若干弊端,应当进行修改和完善。

Discontinuance of Crime is approved and supported act in our country's law and Sociology,and it distinguishes one who discontinues a crime in nature.On the value orientation,the lagislator should limit the scope of one who discontinues a crime to felony,practice course and the course after practice in process of Commission of crime.The Condition of discontinuance of crime is Cant be Confused the Condition of one who discontinues a crime.Several cankers in our country's criminal legislation stipulation about the one who discontinues a crime should be modified and perfected.
