2014年我国规范性文件中已经出现关于值班律师制度的规定。2018年刑事诉讼法将值班律师制度写入立法,规定了值班律师具有法律帮助的职责,但对其性质和权利仍然没有明确。规范上的漏洞导致了实践中法律帮助不力的问题,许多学者提出应当明确值班律师的辩护人地位并赋予其相应权利。从国外的情况来看,值班律师实质上是辩护律师。在我国,值班律师也是在行使辩护权。我们建议将值班律师改名为值班辩护人,将来就会有三种辩护人:委托辩护人、指定辩护人、值班辩护人。"值班辩护人"的职责和权利应当以其在"值班"的岗位上能够完成为限。规范制订者应当根据值班的工作方式和辩护的基本性质这两大立法根据来确定值班辩护人的职责和权利。

dc.description.abstract
In 2014, there were regulations on the duty lawyer system in China's normative documents. The Criminal Procedure Law of 2018 puts the duty lawyer system into the legislation, which stipulates the duty of duty lawyers to provide legal help, but its nature and rights are still unclear. The loopholes have led to the problem of weak legal help in practice. Many people in the academic circles have proposed that the duty lawyer's status as the defender should be clearly defined and the corresponding rights should be given. In foreign countries, the duty lawyer is essentially a defense lawyer. In China, the duty lawyer is also exercising the right to defend. We recommend changing the duty lawyer to a duty defender. In the future, there will be three types of defenders: a deputy defender, a designated defender, and a duty defender. The duties and rights of the "duty defender" should be limited to the extent that they can be completed in the "on duty" position. The regulator should determine the duty and right of the duty defender according to the two legislative bases: the working mode of duty and the basic nature of defense.
