公安机关作为案件的最先接触者,侦查权的行使似乎成了刑事诉讼程序的中心环节,而检察权和审判权相对被弱化,导致出现冤假错案,违背了保障人权的初衷。为了杜绝冤假错案的发生,在党的十八届四中全会上提出了推动以审判为中心的诉讼制度改革,该制度要求各项诉讼活动都要围绕审判开展,并要求侦查权得到一定程度的控制。控制侦查权需要构建立体化控制体系,需要侦查机关及侦查人员更新侦查观念、提高侦查手段和转变侦查模式。

  • Since the public security organs contact a case at first time, the exercise of investigation power has seemingly become a central link of criminal litigation, while the procuratorial power and the judicial power have been relatively weakened, and the resulting injustice has gone against the original intention to protect human rights. In order to prevent the occurrence of unjust, false and wrong cases, the fourth plenary session of the 18 th central committee of the CPC put forward the reform of trial-centered litigation system, requiring all litigation activities be carried out around trial, and urges the investigation power be controlled to a certain extent. For effective control of the investigation power,it's imperative to build up a three-dimensional control system, renew the investigation concepts of the investigative organs and investigators, and improve the investigative means and modes.
