文章依据主体不同,将涉民族因素社会矛盾纠纷划分为少数民族内部、少数民族之间、少数民族与汉族及少数民族与行政机关、企事业单位的矛盾纠纷四种类型。不同类型的矛盾纠纷,由于其内容、性质、特点差异巨大,需要在法治化的总体要求下构建分类化解机制,并综合考虑国家法、习惯法在矛盾纠纷解决中的作用,以利于此类矛盾纠纷得到合法公正有效的解决。

  • Depending on the subject, we can divide the social contradictions and disputes involving ethnic factors into four types: internal contradictions and disputes between ethnic minorities, between ethnic minorities, between ethnic minorities and the Hans, and between ethnic minorities and administrative organs, enterprises and institutions. Different types of conflicts, Because of the huge difference in its content, property, characteristic,it is necessary to construct the classified resolving mechanism under the general requirement of legalization, and consider the role of national law and customary law in resolving conflicts and disputes, in order to resole these disputes facilitate the legal, fair and effective.
