摘要：

有关知识产权产品平行进口的合法性问题始终争议不断,传统的权利穷竭原则和默示许可理论皆不能为其提供充分的法理依据。以我国建设发展自由贸易区为时代背景,因循实用工具主义法学的研究路径,在知识产权法的立法目的、知识产权法的贸易政策面向以及自贸区制度建设的目标组成的"三位一体"价值引导下,原则上,自贸区内知识产权产品的平行进口应当合法化。

  • The legality of parallel import of intellectual property products is always controversial. Traditional exhaustion principle and implied license theory cannot provide sufficient legal basis for it. Under the background of the construction of free trade zones in China,the research path of utilitarianism should,in principle,support the legalization of parallel import in free trade zone by virtue of the value guidance of the "trinity"——the legislative purpose of intellectual property law,the trade policy orientation of intellectual property law and the institutional construction of free trade zones.
