高校内部管理中法律纠纷多数源于高校管理与学生维权的冲突。大学生既享有宪法赋予公民的基本权利,又享有作为受教育者特殊的法定权利。明确学生的权利是保障学生合法权益的基本前提,也是维持正常教学秩序的需要,更是高校实现学生现实权,构建和谐校园的要义所在。

The legal conflicts in university management mostly stem from the conflict between university management and right-maintaining of students. University students enjoy both the basic right endowed by the constitution and the special legal right as an educated. Clarifying the right of students is the basic premise to guarantee the legal right of students, also the need to maintain a regular teaching order, still the purpose that universities realize the realistic right of students and build the harmonious campus.
