摘要：

破坏生产经营罪的网络异化形式包括利用技术手段破坏计算机等方式破坏生产经营的行为和以计算机网络为犯罪工具的破坏生产经营行为。两种行为的法律适用困境在于对破坏生产经营罪"其他方法"如何进行解释的问题,传统观点对于破坏生产经营罪"其他方法"的解释已经不符合互联网时代背景的基本语境和不断变化的经济发展形式。消解破坏生产经营罪网络异化所存在的归责障碍,应当通过对刑法解释的效力位阶进行分析进而探索"其他方法"的基本解释路径,最终作出符合刑法客观目的的解释。

  • The forms of network alienation of the destroying production and business operation crime include the acts of using techniques methods to destroy computers or using computer networks as criminal tools to sabotage production and operation. The law application diploma of these two acts is how to explain the"other methods"of the disrupting production and business operation crime. The traditional explanation for the "other methods" has been unable to be in line with the basic context of internet historical background and constantly changing economic development modes. To eliminate the imputation obstacles existing in network alienation of the destroying production and business operation crime, we should analyze the effective rank through criminal law interpretation and explore the basic explanation route of the "other methods" so as to make the interpretation consistent with the objective purpose of the criminal law.
