自由幸福是美好生活的集中体现;追求自由幸福是"增强中华民族共同体意识"的强大动力;中国特色社会主义法治的根本使命就是保障每一个个人追求和实现自由幸福。法治的自由价值和幸福价值高度关联融合。自由是幸福的前提,幸福的本质是人的自由全面发展。自由幸福是最高位阶的价值,意味着人生存和发展的完满;法治则是实现普遍自由和幸福的首选方式。资本主义使追求自由幸福合法化,却因其"虚假共同体"的本质而制约着自由幸福的普遍化。新时代中国特色社会主义法治聚焦自由幸福这一根本价值,既为人民追求美好生活护航,也促进"真正的共同体"——人类命运共同体——的建构,为实现普遍自由幸福开辟了广阔的前景。

  • Asfreedom and happiness arethe most important reflection of a better life,the pursuit of them is apowerful driving force for "enhancing the consciousness of the Chinese nation community".Therefore,freedom and happiness themselves and the guarantee of the right of every individual to pursue them are the ultimate values of the rule of law.Freedom is the premise of happiness while the essence of happiness is the freedom and all-round development of human beings.Manifested in the value levels of the rule of law,the two are both parallel and progressive.Freedom and happiness are the values of the highest order,which means the perfection of human existence and development,and the rule of law are the preferred way to achieve universal freedom and happiness.Capitalism legitimizes the pursuit of freedom and happiness,but it restricts the universalization of freedom and happiness because of the essence of its "false community".The socialist rule of law with Chinese characteristics with a focus on the ultimate value of freedom and happiness nut only guarantees people's pursuit of a better life,but also helps to construct the community of a shared destiny in a real sense,and thus promises aprospect for the realization of universal freedom and happiness.
