摘要：

为维护社会公共利益需要,我国确立了土地征收制度。但实践中,我国土地征收制度越来越暴露出其不适应性,土地征收过程中,损害农民权益及农民集体利益的情形时有发生,并对社会稳定产生了消极的影响。为使我国的土地征收制度适应市场经济的要求,必须尽快建立一个既能确保适度管制,又能促进农地流转的农地制度体系,以更好地维护农民的合法权益。

  • In order to protect public interests of society,China made land requisition system.But in practice,China's land requisition system is more and more not suitable for protection of peasant rights and hurts the interests of peasants and collective interests and influences the stability of society.In order to make China's land requisition system suitable for the demand of market economy,the land requisition system which can protect the interests of peasants and which can promote the selling and buying the land of the peasants should be established to protect the legal right of the peasants.
