在私法领域,意思自治原则历经几个世纪的嬗变依然活跃。而作为国际商事仲裁乃至整个国际私法制度的基本原则之一,意思自治原则也显示出旺盛的生命力。它贯穿于整个国际商事仲裁的过程中,既是实质要件又是重要原则;即是骨架又是灵魂。而我国的仲裁制度中同样也贯穿了意思自治原则,在即将修改的《仲裁法》中应进一步体现意思自治原则的灵魂作用并加以灵活应用,以便在新的环境条件下与国际商事仲裁制度接轨。

  • In the private law area,the Autonomy of Will Principle has been active over several centuries.As one of the basic principles of the international commercial arbitration rules,the principle also shows its outstanding vitality.The Autonomy of Will Principle,which goes through the process of international commercial arbitration rules,is not only its essential prerequisites,but also its important principle.Furthermore,the principle also goes through our own arbitration system.And the Arbitration Law that should be amended soon,should further reflect this principle and apply it agilely,in order to catch up with the rapid development of international commercial arbitration.
