社交网络隐私保护问题研究 ——以新浪微博为例

摘要:

保护隐私是人类现代文明进步的重要标志,也是人对自由和尊严的维护。媒介技术的高速发展和广泛应用使得传统的个人隐私保护面临前所未有的挑战,人类在享用媒介技术所带来的种种利益的同时,所拥有的个人隐私也正在逐步消失,社会中每个人似乎正生活在一个“透明的社会”之中。在媒介技术高度发达的社交网络Web2.0时代,社交网络颠覆了传统的体制性传播。新的信息传播机制将网络空间的“私人领域”逐渐公有化形成网络公共领域,由公私领域的划分而提出的隐私概念面临新的境况。以分享和交流为目的社交网络赋予我国公民言语表达自由的同时,也加剧了侵犯公民隐私的危险性,拓展了隐私权保护的内涵。以新浪微博为研究对象,从媒介技术和公共领域的理论视角出发,对新浪微博平台及其用户进行详细的分析,微观层面探寻隐私问题被卷入社交网络公共领域的缘由,进而讨论社交网络隐私权各权力主体间的权益较量,以期发现传统隐私权在社交网络时代保护公民隐私所面临的困境,最终找到适合于社交网络公共领域的隐私保护途径。经过一系列研究后发现,社交网络的数字空间和用户的自我展露打破了传统公私领域界限,促进私人领域的公有化;信息传播机制和用户窥视心理又为社交网络公共领域的隐私侵权提供了丰富的“原料”,加剧了该领域隐私问题的诞生及伤害。社交网络公共领域中公权力、平台、媒体和用户之间为各自的隐私权权益发生“争夺”,使得传统隐私权在社交网络公共领域中缺乏适切性,出现了公私“二分制式”的瓦解、侵权主体难以追踪、隐私保护范围难以厘定等隐私保护问题。因此,社交网络用户提高社交网络公共领域隐私意识和行为自制力,平台当好信息善良的“管理人”,法制层面汲取国外社交网站隐私保护的经验,才能构建安全健康的社交网络环境,更好地保障公民的隐私权。

  • To respect and protect privacy is a defence for human freedom and dignity, and an important mark of human civilization as well. However, while bringing huge benefits to human, the application and development of new media also causes unprecedented tough challenges for traditional individual privacy protection. In current society, everyone’s individual privacy is vanishing, and our society seems to become a “transparent society”.In the social networking Web 2.0 age with high-developed media technology, social network has covered the traditional institutional communication. Thanks to the new system of information communication, the “private field” in network space is gradually becoming a public network field, and the concept of privacy caused by public-private field is facing a new situation. With the purpose of sharing and communication, social network endows our citizens with the freedom of speech, but meanwhile it also aggravates the risks of privacy infringement, and expands the connotation of privacy protection.With Sina Weibo as its research object and from the perspective of media technology and public field, this thesis tends to make a detailed analysis about the Weibo platform and its users, as well as the reasons why privacy issues are involved in the social network from the micro-level, so as to discuss the privacy-related competition between each right entity on social network, and to discover the plight of traditional privacy protection, and finally find out a proper protection approach that suits for the public field of social network. Through a series of researches, it finds out that the traditional barriers between private and public field has been broken by the digital space of social network and the initiative exposure of users, which facilitates the socialization of public field; in addition, the information communication system and users’spying psychology also provide abundant “raw materials” for the privacy infringement of the public field on social network, which aggravate the emergence and the risks of privacy issues. On social network, the competition for privacy right between entities like public powers, platforms, media and users, will cause many problems for traditional privacy, such as the deconstruction of “dualistic system” between the public and the private, the difficulty of tracing infringement entity, and the difficulty of defining criteria for privacy protection domain. Therefore, users of social network should improve their awareness of privacy protection in public field, enhance their behavioral self-control; and the platforms should serve as a “manager” who can maintain a friendly environment for information; also, foreign experience for privacy protection should be involved in the laws and regulations. Only in this way, can we build up a safe and healthy environment for social network, and better safeguard the privacy right for citizens.
