民事诉讼法背后的人性假设——兼论两种审判方式并存的合理性

社会科学和人文科学往往以一定的人性假设为“公设”,并以此推导和构建它的理论系统。现行民事诉讼法背后所蕴含的人性假设为法官是全知全能且无偏无私的、当事人缺乏足够能力且不能完全相信。这一假设并不完全符合中国社会的现实。民事诉讼法的修改应从中国社会的现实出发,根据熟人社会和陌生人社会、发达地区和不发达地区的差异,确定与之相适应的两种不同的人性假设和民事诉讼程序。

  • Social science and the humanities often rely on some hypotheses of human nature as “postulate” on which the relevant theoretic system is derived and constructed. The hypothesis of human nature in the existing civil procedure law supposes that the judge is omniscient and omnipotent and impartial while the client has not enough capacity and is not completely trustworthy. This hypothesis does not correctly reveal the reality of China. The amendment of the existing civil procedure law should take the reality of China into consideration and work out two suitable hypotheses of human nature and relevant civil procedures according to the differences between the society of acquaintances and the society of strangers and those between the developed area and the underdevelopment area.
