摘要：

摘 要美国证据法经过两百多年的发展历程，积累了丰富的理论资源和实务经验，对我国证据法的制定和完善也有着重要的借鉴意义。因此，笔者选择《联邦证据法精要》第一节和第二节作为本次翻译项目的研究对象。该书由美国证据法界的著名学者Michael H. Graham教授编写，以短小的篇幅，简明的方式，逐条介绍了美国证据法的内容，是一本学习和研究美国证据法的入门书。《联邦证据法精要》第一节和第二节的翻译难点主要是法律词汇的多义性和句法结构的复杂性。在处理法律词汇多义性时，笔者认为根据语境确定意义后，才能使词汇的翻译准确无误；在处理复杂的句法结构时，采用了变序法、拆分法、转换法三种翻译技巧。

  • AbstractAfter two hundred years of development, the United States law of evidence has accumulated rich theoretical resources and practical experience, whichhas a significant reference to the establishment and improvement of evidence law in China. Therefore, the author chooses article 1 and 2 of Federal Rules of Evidence in a Nutshell as the research object. This book, written by Michael H. Graham,who is a famous scholar of law fields in the United States, itemizes main provisions of Federal Rules of Evidence in brief paragraphs and concise way andis a great guide to thestudy and research of United States evidence law. The main difficulties of the translation text are polysemy of legal terms and complexity of syntactic structures. In dealing with polysemy of legal terms, the meaning shall be determined in light of the context so that they can be translated precisely; and in dealing with the complicated sentences, translation techniques of order-changing, splitting, and transformation are adopted.
