摘要：

刑罚威慑的功利价值,是指刑罚威慑功能的发挥在实现刑罚目的方面所具有的有用性。这一问 题包含着两个方面的内容:一是刑罚威慑的功利价值的指向问题,即刑罚威慑的功利价值是以刑罚目的的实 现为价值内涵的;二是刑罚威慑的功利价值的外在表现问题,即刑罚威慑的功利价值表现在哪些方面。本文 认为,刑罚威慑在实现刑罚预防犯罪的功利价值方面具有廉价性的特点,它理应受到现代刑事立法和刑事司 法的充分重视。

  • Detering utility value of penalty refers to it's usefulness in realizing the penalty goals. It involves two issues; one is the direction of the penalty deterring, the other is the external performance of the penalty deterring. The author believes that the penalty deterring is inexpensive when preventing the crime . Compared with other penalty functions, it should be paid enough attention by the modern criminal law legislation and the criminal judicature.
