国际保理从性质上说是一种债权的转让。相对于L/C和其他几种贸易结算方式,在国际保理业务中银行所承担的风险期限最长,也最容易受到不确定的风险诱因所影响。国际保理中银行的法律风险分为直接的和间接的,总的说来呈现一种多头并存,权利交织复杂的局面。

To the very nature of international factoring,it is a transformation of creditor’s right.As for the key role in international business,the bank must take the risking period longer than that of the letter of credit.The legal risk of bank in international factoring is divided into two sorts: the direct risk and the indirect one.On the whole,there exists a complicated web where different rights interact each other.
