无论是大陆法系还是英美法系,利他合同中第三人权利都得到了较好的保护。但是我国迄今没有利他合同的一般规则,对第三人权利的保护远远不够。我国应借鉴发达国家对利他合同的研究成果,完善我国利他合同制度理论并进行立法改进,以期加强保护第三人之权利。

The right of third part is protected firmly in a co nt ract to be performed to third part ,whether in continental law system or common law legal family .But so far,there is not a common rule of a contract to be perf ormed to third part in our country where the protection of the right of third pa rt is not enough .In order to improve the protection of the right of third part ,the thesis attempts to use the research achievement of developed countries,putt ing forward theoretical analysis and legislative improvement for our country of contract to be performed to third part.
