论驰名商标的认定与淡化—以“红河”商标侵权纠纷案为例

摘要:

商标作为区分不同商品来源的标志,是企业的无形资产,尤其是驰名商标,它不仅代表着企业的良好形象,还蕴含着巨大的经济价值。自从2001年加入WTO以来,我国市场经济获得飞速发展,驰名商标的数量也急剧增加。在我国驰名商标主要是由商标行政管理机关认定,但是在司法实践中,法院在具体案件中也可以对争议商标的驰名度进行认定,但因为二者的认定标准不尽相同,再加上我国相关法律对驰名商标认定的形式要件及程序问题并未做出具体规定,致使驰名商标在实践中出现认定标准混乱的现象。研究驰名商标的认定有利于更好地保护驰名商标及其所有权人的权益,以及更好地维护良好的市场竞争环境。 当前,世界经济日趋全球化,国与国之间、地区与地区之间的经济贸易往来越来越频繁,而具有区别及表彰作用的驰名商标在这个过程中的地位越来越重要。商标的驰名度越高,受到侵害的可能性也就越大,当前,侵犯驰名商标的方式越来越多,商标淡化就是对其的一种特殊的侵权形式。对此,传统的商标保护方法已力所不能及,需要有新的理论来加以保护。司法实践中已有大量驰名商标被淡化的案例出现,但我国法律目前仍未明确引入商标淡化制度,因此,研究商标淡化理论迫在眉睫,且意义重大。本文从案例分析入手,以“红河”商标侵权纠纷一案为视角,对驰名商标的认定及驰名商标淡化进行研究。第一部分,案情介绍,通过案情的简单介绍以便于对该案件有个初步的了解,总结案件的争议焦点,进而提出有关的法律问题。第二部分,研究驰名商标的认定问题,分三个层次:(1)研究驰名商标的内涵。通过介绍国际条约、不同国家和地区以及我国的法律对驰名商标的不同规定及有关学者对驰名商标概念的理解,提出自己对驰名商标概念的理解::在中国境内经过长期实际使用,为相关公众所熟知的,具有较高知名度及较强显著性的商标。(2)研究驰名商标的认定标准,主要是对驰名商标所涉及的四个要素的研究,即知名度、地域范围、相关公众、显著性。(3)本案中“红河”商标是否驰名的认定,结合上面驰名商标认定中所要考虑的四个因素来研究“红河”商标是否属于驰名商标,得出“红河”商标属于驰名商标的结论。第三部分,研究驰名商标淡化的认定,分为三个层次:(1)商标淡化内涵的研究。通过对“淡化”的释义提出自己对商标淡化概念的理解,即商标淡化是指非商标所有权人擅自将与商标所有权人的驰名商标相同或相似的商标用于不相同、不相似的商品或服务上,弱化驰名商标的识别性、显著性,或者损害其商誉的行为,而不论商标权人与非商标权人之间是否有竞争关系,也不论该使用行为是否会引起人们的误解、混淆,是否存在欺骗的可能性,或者造成实际的经济损失。(2)研究商标淡化的认定,主要从三个方面研究并阐述自己的观点:1商标淡化的构成要件,包括两个:淡化的对象必须为具有高知名度及强显著性的驰名商标,而非普通的驰名商标;商标淡化以“淡化之虞”为要件,不需要造成“事实淡化”。2商标淡化的分类,包括三类:弱化、丑化、退化。3研究将他人的驰名商标用于商品的包装、装潢的行为是否属于商标淡化的表现形式。(3)分析本案中被告的行为是否构成对“红河”商标的淡化,主要从认定商标淡化的三个方面分别加以分析,得出被告的行为属于对“红河”商标淡化的行为的结论。第四部分,适用商标淡化理论保护驰名商标的时间起点问题研究。(1)首先通过分析国际上及不同国家对该问题的法律规定,提出自己观点。即利用商标淡化理论保护驰名商标,应当以该商标事实驰名为起点,而不能以有关机关的认定为起点,而且无需考虑侵权人的主观恶性。(2)分析在“红河”商标被认定为驰名商标之前,被告的行为是否构成对“红河”商标的侵权,得出被告的行为仍构成了对“红河”商标的侵权的结论。

  • The trademark is a mark of identifying the origin of different goods, and it is the important intangible asset of enterprise, especially the well-known trademark. It is not only the represent of the images of enterprises, but also condenses enormous economic value. Since China entried into WTO in 2001, the market ecnomy develops quickly, and the number of the well-known trademarks increases fast, too. In China, well-known trademark is recoggnized mainly by trademark administration agency, in judicial practice, the court can also identify the famous degree of trademark in a specific case. but because their standards are not the same, also the relevant laws in our country do not make specific provision on elements of form and program problem of the recognition of well-known trademark, resulting in the cognizance of the well-known trademark arises standards chaos phenomenon in practice. Resuring the cognizance of the well-known trademark is very significant for protecting the well-known trademark and the legal rights and interests of the owner of a trademark better, and also, it is very significant for maintaining the healthy makket competition environment.At present, the world economic is globalization economic, and the economic and trade exchanges between country and country, or area and area is more and more frequent. And the well-known trademark which has the difference and recognition function is becoming more and more important in this process. A trademark is more well-known, but also more vulnerable. At present, the well-known trademarks′ tort form is more and more, the trademark dilution is a kind of special tort form. The traditional trademark protection method has been unable to meet the demand for protecting well-known trademarks. There is a need for new theories to protect them. Therefore, studying the theory of trademark dilution is imminent, which has important significance.The article begins with case analyses, taking the trademark infringement dispute case between Honghe Cigarette Factory and Kunming city Yiliang gold washing supplies limited company as the angle of view, to study the cognizance of well-known trademark and well-known trademark dilution. The first, case introduction. We can have a preliminary understangding on the case by simple introduction, and summarize the disputes, and put forward relevant legal issues.The second, the well-known trademark determination problem study. Include three levels: (1) Study connotation of well-known trademark. Through the introduction of international treaties, the law of different countries and regions as well as our country, and the understanding about the well-known trademark concept of related scholar, then put forward my own understanding of the concept of well-known trademarks in China: the well-known trademark is a trademark that is used for a long time and widely known by the relevant public, and which has high visibility and strong distinction. (2) Study determination standard of the well-known trademark. Mainly study popularity, geographic scope, the relevant public, significant of the well-known trademark.(3) Study the issue that "Red River" trademark is well-known trademark or not. By studying the four factors to study wether "Red River" brand is well-known trademark or notWe can come to conclusion that the" Red River" brand is well-known trademarks.The third,well-known trademark dilution study. Include three levels: (1)the connotation research of trademark dilution. Through the study, the meaning of well-known trademark dilution is that a person who is not the well-known trademark owner, uses trademark that is same or similar as well-known trademark in its goods or services which are different from former goods or services, resulting in the well-known trademark recognition, significant weakened, or goodwill impairment behavior, regardless of whether the use behavior will cause misunderstandingor whether there is competition between the owner of well-known trademark and others ,or whether there is confusion, misunderstanding, possibility of deception or economic actual damages. (2)Study trademark dilution determination. Mainly from three aspects to study it, and explain my own point of view:1Constitutive requirements of trademark dilution. Includes two: the object of trademark dilution must have higher visibility and stronger significant than ordinary trademark; trademark dilution use "downplay danger" as the elements, and do not need cause " fact desalination" 2trademark classification. Includes three categories: weakening, beautify, degradation. 3study if this act that useing others well-known trademark for goods packaging, decoration is the manifestation of trademark dilution or not. (3) Analysis wether the defendant's conduct is the dilution act to "Red River" trademark, mainly from the identification of trademark dilution form three aspects to analyze.We can get this conclution that the defendant's conduct is the dilution act to "Red River" trademark.The fouth,studying the beginning time of using the theory of trademark dilution. (1)By analisising laws about this question in different countries, I put forword my own view. That is, the time of protecting well-known trademark begins from the fact well-known, but should not take the relevant authorities identified as a starting point. Without considering the infringer's subjective malignant.(2)analysis that wether the defendant's conduct is a dilution act to "Red River" t`rademark before "Red River" trademark identified well-known trademark.We can get this conclution that the defendant's conduct is the dilution act to "Red River" trademark
