深化司法改革是中国特色社会主义法治国家建设的基础和前提。我国的司法改革在过去的近三十年中取得了巨大的成效,但司法公信力的状况却不容乐观。理论上,司法公开可能是提高司法公信力的有效途径。本文使用CGSS 2012和中国司法透明度年度报告(2011)数据,评估了司法公开对司法公信力的影响,工具变量方法估计表明,司法公开程度的提升显著提高了司法公信力,司法公开每增加一个标准差(15.567),司法公信力水平提高9. 50%左右;同时,司法公开的分项指标实证研究显示,加大执行信息和审判信息公开力度是当前司法改革的重中之重,也是有效提升我国司法公信力的最优策略。上述研究结果对我国新时代下司法改革的战略调整有重要的参考价值。

  • Deepening the reform of the judicature is the basis and prerequisite for the construction of a country under the rule of law with Chinese characteristics. The judicial reform of our country has made great achievements in the past thirty years,but the state of judicial credibility is not optimistic. In theory, judicial openness may be an effective way to improve judicial credibility. The article uses the data of CGSS2012 and Chinese annual report on judicial transparency(2011) to evaluate the influence of judicial openness on judicial credibility. Instrumental variables estimation method show that the judicial openness significantly contributes to enhancing judicial credibility, if the judicial openness is increased by a standard deviation(15. 567), the judicial credibility level can be increased by about 9. 50%; at the same time, an empirical study of the sub index of judicial openness shows that strengthening the openness of executive information and trial information is the most important part of the current judicial reform, and also it is the best strategy to effectively improve the judicial credibility of our country. The above results have important reference value for the strategic adjustment of the judicial reform in the new era of China.
