摘要：

中国已成为世界第二大海外投资国,但大量海外投资分布在安全风险高的发展中国家和最不发达国家,国家现存防范安全风险的法律体系和法律制度与之不相适应,无法充分保障海外投资的国家利益和投资者合法权益。从建立健全中国海外投资保险法律制度、国家促使投资者充分利用MIGA担保制度、构建中国特色投资条约"保护与安全"和"保护伞"条款、建立健全中国实施外交保护国际法依据四个方面建构了中国海外投资安全风险法律防范的基本体系与主要制度。

  • While China has become the second largest outward investment country in the world,China' s overseas investment is mainly distributed in developing countries and the least developed countries with high security risks,and China' s existing legal systems and institutions for preventing such security risks cannot accommodate to practical demands of full protection of the national interests and investors' legitimate rights and interests. This article constructs the basic systems and main regimes of legal precaution of investment security risks in four aspects: establishing and improving the legal system of Chinese overseas investment guarantee,promoting the investors to make full use of MIGA' s guarantee system,constructing "protection and security"and "umbrella " clauses in investment treaties with Chinese characteristics,establishing and improving the international legal grounds of China' s diplomatic protection.
