高利贷衍生犯罪可以类型化为寄生型犯罪和倒逼型犯罪。从表面上看,高利贷衍生犯罪是借贷方实现高利贷非法利益的必然手段。从本质而言,高利贷衍生犯罪与高利贷作为一种反信任机制的特质相关联。而银行信贷的身份型信用体制及当前我国社会信用危机则是导致高利贷衍生犯罪不断恶化的条件。对于高利贷衍生犯罪的治理策略有两种:一种是"西医疗法",即通过高利贷入罪,以刑罚直接打击、阻却高利贷的方式,实现其衍生犯罪的治理。另一种是"中医疗法",即通过对社会信任的恢复及对信用有效规制,以实现高利贷衍生犯罪的治理。"西医疗法"固然对抑制高利贷衍生的犯罪会有一定疗效,但可治标,难治本。要源头治理,则必须重视并依赖中医疗法。

  • The crime induced by usury can be divided into two kinds: the parasitic crime and the forced crime. On the surface,the crime induced by usury is the inevitable way to seek the illegal interests of usurer. In essence,the anti-trust characteristic of usury is the important reason for the crime. The conditions of crime induced by usury are the identity credit system of bank and the credit crisis in China. There are two strategies to control the crime induced by usury. One is " western medicine therapy",it control the crime induced by usury with criminal law. The other one is " traditional Chinese medicine therapy",it control the crime induced by usury through trust reconstruction and effective credit regulation. Actually,It Can control crime in a way by the " western medicine therapy",but is a temporary action instead of total solution. The " traditional Chinese medicine therapy" must be adopted if the crime induced by usury can be fundamentally controlled.
