本文从死刑废除论的起源、死刑存废争论的焦点等方面考察了国外死刑存废之争与人道主义的关系 ,指出国外始终是以人道主义作为考察死刑存废问题的根基 ,并提出应当以人道主义的精神来审视死刑是存是废的结论。

From the discussion of the abolishment of death penalty and the controversy between keeping and abolishing death penalty, the author studies the relation between the controversy of keeping and abolishing death penalty abroad and humanism and points out that in foreign countries the controversies always has been based on humanism and concludes that while surveying the keeping or abolishment of death penalty people should base it on humanism.
