"三权分置"改革是继家庭联产承包责任制后深化我国农村土地制度改革的又一重大政策制度创新。中国民法典物权编编纂应当与《农村土地承包法》修改联动进行,积极回应"三权分置"改革。"落实集体所有权"并不要求创设农村集体经济组织法人土地所有权,应当继续坚持《物权法》的立法设计,农民集体为农村集体土地所有权主体,农村集体经济组织法人为行使主体。"土地承包权"与"土地承包经营权"具有同质关系,应当增加规定国家保护农村土地承包关系稳定并长久不变的宣示性规范,强化土地承包经营权的期限以及承包期内发包方不得随意调整或者收回承包地的义务,并充实土地承包经营权的抵押权能。土地经营权应为中国民法典物权编新增用益物权类型,应增加一章专门规定土地经营权的基本内容,并明确土地经营权的物权变动模式为登记生效主义。

  • The reform of the Three Rights Division is another major policy and system innovation to deepen the reform of China's rural land system after the household contract responsibility system. The codification of real right in China's Civil Code should be coordinated with the "Rural Land Contract Law"thus actively respond to the Three Rights Division Reform. The implementation of collective ownership does not require the creation of rural collective economic organization legal person land ownership,it should continue to adhere to the property law of the legislative design,farmers collectively is the main body of rural collective land ownership,and the rural collective economic organization is the main body of artificial exercise. It is not appropriate to specify the definite legal structure of the legal person of the rural collective economic organization in the Civil Code,while it is advisable to stipulate in the special civil law. Due to the homogeneity of land contractual rights and land contract management rights,the state shall increase the oath-taking norms governing the protection of stable and permanent rural land contracting relations,strengthen the term of the land contract management right and the contract party shall not arbitrarily adjust or reclaim the obligation of the contracting place,and enrich the mortgage ability of the land contract management right. The land management right should be the type of the new usufructuary right of the Chinese Civil Code,and the basic content of the land management right should be added,and the real right change mode of land management should be defined as the registration entry into force doctrine.
