破产程序与执行程序的冲突问题,不仅是人民法院执行工作中的一大突出问题,也是破产案件审理中必须首先解决好的问题。要从根本上解决执行程序与破产程序的冲突问题,必须正确界定破产程序开始的时间、准确把握执行程序终结的判断标准以及在破产受理前采取保全措施。文章对此三个问题进行了探讨,并在此基础上对破产程序中各具体债权的执行工作进行了初步研究。

  • The conflict between bankruptcy proceedings and execution procedures is not only a prominent problem for the people's courts in their work, but also a problem that needs to be well-resolved at first in adjudicating bankruptcy cases. To settle this problem completely, the court must fix the exact beginning time of bankruptcy proceedings, adopt standards that see whether the execution procedures are over, and assume necessary security measures before accepting bankruptcy cases. Based on observations related to these three aspects of the problem, this article also discusses the various specific processes that can be resorted to when the right of a creditor arises from the bankruptcy proceedings.
