摘要：

随着服务型政府建设的推进,具有合作性、自治性的行政合同在实践中得到广泛运用,而行政合同的司法审查尚处于无意识状态。研读、梳理行政合同司法判决书,发掘当前行政合同司法审查在受案范围,效力认定,变更、撤销、解除,行政合同的前行为以及行政赔偿等方面存在的问题,并进行理论与实践的分析,有助于促进行政合同司法审查制度的发展。

  • With the advancement of service-oriented government construction,the administrative contract with cooperation and autonomy is widely used in practice. However,given the weak theoretical research and rough provision,the judicial review of the administrative contract is in an unconscious state. Through studying and combing judicial decision of administrative contract,this paper attempts to explore the problems of judicial review of the current administrative contract which includes the scope,validity,change,revocation and cancellation of the case,as well as the administrative act before the administrative contract and the administrative compensation.At the same time,through anglicizing these problems in theory and practice,we hope to promote the development of administrative contract judicial review system.
