摘要：

随着全球治理话语博弈的加剧,传统国际格局正在深刻地调整演变,单一的国际法治模式规制愈显乏力。在此背景下,要引导国际社会共同塑造更加公正合理的国际新秩序,共同建构和维护"人类命运共同体",就应当借鉴弘扬中国"法治"与"德治"融合互动的社会治理经验和模式。国际社会应协同建构"国际德治"规则和理论体系,进而推进全球治理体系内"国际德治"与"国际法治"融合互动的"双擎模式"的建构。具体而言,厘清该模式应有之内涵要素、合理衡平协调与现行国际法原则规范体系之间的关系、探索推进"道德"与"法律"融合互动机制、建立监督评价机制与奖惩激励机制均具有重大意义。

  • With the competition between different discourses on global governance becoming intense, the traditional landscape of international relations has undergone fundamental changes so that the global governance which is based only on rule of law has become increasingly inadequate. Against such a background, any attempt to lead the international community to work together to build a more fair and reasonable international order as well as constructing and protecting "a community with a shared future for mankind" requires the adoption of China's experience in and mode of social governance characterized by an integrated interaction between "rule of virtue" and "rule of law". The international community should make concerted efforts to build an international regime and a theoretical system of rule of virtue, and accordingly promote the construction of a double-engine model for global governance characterized by the integrated interaction between rule of virtue and rule of law. Specifically, it is of great significance to make the following achievements: to clearly identify the elements of such a double-engine model; to appropriately coordinate this model with the current international law system; to explore the mechanism for the integrated interaction between rule of virtue and rule of law; and to establish supervision, evaluation, reward and punishment mechanisms.
