拟制自认并非真正意义上的自认,它是立法者为达到一定的诉讼目的或追求某种诉讼价值,通过法律将一方当事人的"不争执""不知陈述"或其他消极的诉讼行为拟制为对另一方当事人事实主张的认可,从而使之产生自认上的法律效果。尽管我国有司法解释对拟制自认作出了规定,但由于相关理论及法律条文的欠缺,实务中的操作依然捉襟见肘。为使拟制自认能够在诉讼中发挥其应有的制度价值,应当明晰其表现形式及正当性依据,通过类型化的分析和构建,对我国自认制度进行完善。

The imitation confession is not the true sense of confession,it is the aim of the legislative person to achieve a certain purpose or pursue some litigation value,one party's "no dispute","unknown statement" or other negative litigation behavior is formulated as the approval of the other party's fact statement by law,so as to produce the legal effect of confession.Although China has stipulated the system of confession in the form of judicial interpretation,however,due to the lack of relevant theories and legal provisions,practical operations are still stretched.In order to make the system admit,it can play its proper system value in the lawsuit,it should be clear about its forms and grounds of legitimacy,and through the analysis and construction of typing,Perfect the system of admission in our country.
