我国核应急信息公开法律制度研究

摘要：

核应急信息公开法律制度对提高核安全信息透明度、保障公众的知情权以及实现公众的核安全监督权具有重要作用。我国的核应急信息公开法律制度存在以下问题:缺乏核设施营运单位的依法参与、公开内容边界不清以及信息公开时限不具有操作性等。这些问题的产生原因在于政府对信息公开裁量权过大、核应急法律法规陈旧、与《核安全法》脱钩等。以上问题的完善不仅是对《核安全法》的立法回应也有助于改进我国突发环境事件的信息公开制度。

  • The legal system of disclosure of nuclear emergency information plays an important role in improving the transparency of nuclear security information,safeguarding the public' s right to know,and achieve public' s supervision on nuclear safety. From a functional perspective,the implementation of the legal system in our country face the dilemma: disclosure of nuclear emergency information lacks participation of nuclear power plant,the blurred boundary of content which should be open,and nonoperability of the limit of time to disclosing information,etc. The reasons for these problems lie in the government's overpower on disclosure of information,outdated nuclear emergency laws and regulations,and the decoupling of the nuclear safety law. The improvement of the above questions is not only the legislative response to the nuclear security law,but also to improve the legal system of disclosure about emergency information in China.
