摘要：

为解决人民陪审员专业化不足而导致的"陪而不审"的功能虚化,我国借鉴英美法系陪审员只负责事实认定的普通陪审制,启动了"人民陪审员不再审理法律适用问题,只参与审理事实认定问题"的参审权改革。但试点情况表明,事实审与法律审的区分在审判实践中如何具体操作难以形成一致意见,"一刀切"的单一陪审模式存在明显的缺陷,客观需要更为多元的陪审制度。而美国咨询陪审制对于解决人民陪审民主化、平民化与司法专业化、职业化之间的矛盾提供了可能的方向,应在人民陪审制改革中引起足够的重视。

  • To solve the impracticability of the people’s jury system due to the jurors’lack of profession,China learns from the common law system on restricting the jurors within fact finding,and conducts the reform of"stop trying legal problems and only try factual problems".The situation of the plots shows that,the distinction between factual issue and legal issue is so difficult to tell that the judicial practice can hardly form a consensus.Theonefold jury system without flexibility has obvious defects,and we should develop polyphyletic system.The advisory jury in the USA can offer China a direction in handling the conflicts between the judicial requirements of professionalization and the jury’s characteristics of democratization and popularization.Therefore,the advisory jury should be paid enough attention during the reform of people’s jury system.
