性别选择权,系指行为人因生理差异或性别焦虑原因依法自主变更为另一目标性别的权利。承认性别选择权,有利于主体资格建构与确证;有利于身份关系认证;有利于婚姻关系缔结和角色定位;有利于社会角色识别。性别选择权有其自然法、宪法和民法基础。性别选择权系人格权、身份权和身体权。性别选择权的行使应具备法定要件,并须履行告知义务、注意义务,遵循类型限定和次数法定的原则。

  • The right of gender choice is the right of the person to change into another target gender according to the physiological difference or the gender anxiety.The recognition of the right of gender choice is beneficial to the construction and confirmation of the subject qualification,which is beneficial to the authentication of the identity relation,and is beneficial to the conclusion of the marriage relationship and the orientation of the role.The right of gender choice is based on natural law,constitution law and civil law.The right of gender choice is the right of personality,the right of status and the right of body.The exercise of the right of sexual selection should meet the legal requirements,and must fulfill the duty of disclosure and the duty of care.
